Legal assistance for children and families in deportation procedures!

Osnabrück, 12.10.2022 - Together with refugee councils, non -governmental organizations and churches, the international child law organization terre des hommes calls on the Federal Government to introduce an obligation to attend attendance in deportation. This is the only way to ensure that those affected receive the right to defend themselves appropriately. This is also of great importance for children and adolescents. Because families in which the children or a parent are separated are often affected by deportation. A large number of such deportation applications turn out to be illegal. The right to the family of those affected is often not or not sufficiently checked, and the child's welfare, as actually prescribed, does not consider primarily. There are also repeated objections to minors due to incorrect age assessments that were carelessly affected by bodies that were not responsible in the sense of child and youth welfare.

In addition, deportation in minors should finally be prohibited by law. This was also recommended by the UN Children's Rights Committee in its evaluation of the status of children's rights in Germany in September. »The Children's Rights Committee has made it clear that there must be an absolute ban on the detention of minors in Germany due to their residence status or that of their parents and that family separations can be prevented in the context of return. We expect the federal government to adhere to these requirements when implementing the coalition agreement, «says Sophia Eckert.

In other areas, too, the UN Children's Rights Committee strengthens the rights of children. The Federal Government once again asked the committee to maintain their interests and needs in all procedures concerned. This affects both the rights of refugee children and, for example, anchoring the right to a healthy environment for all children in German legislation and the waiver of recruiting voluntary minors for the Bundeswehr.
