Common press release from the Federal Fundamental Association, Terre des Hommes, young people without borders and pro asylum
Berlin, November 30, 2022 - In the last few meters, a lazy compromise in the law on the introduction of a opportunities for opportunities threatens at the expense of refugee young people. This is to be decided in the Bundestag on Friday.
The Federal Association for Hommes, adolescents without limits and pro asylum criticize that the future of young people is installed in order to achieve a compromise and call on the MPs not to agree to the tightening.
As could be experienced yesterday from coalition circles, it was agreed to accept tightening rights for well -integrated young people and adolescents (§25a AufenthG) so that the FDP agrees to the legislative proposal.
§25a AufenthG currently stipulates that well -integrated young people can maintain the right to stay if they meet certain conditions - including a successful school attendance or school leaving certificate, impunity and a four -year preliminary stay. The pre -stay time is to be reduced to three years with the new regulation.
At the urge of the FDP, a one -year payment period is now to be introduced as a hurdle, which is not yet a prerequisite. In fact, this new regulation would cause significantly fewer young people to benefit from the regulation than previously planned and that immigration authorities are given the opportunity to deport well -integrated young people during the foronity period.
If this regulation comes, the distribution would decide on the chances of staying right. Federal states and immigration authorities who pursue a restrictive line could try to pry away the right to stay - for example by not granting any tolerations and therefore no pending time.
At the same time, the regulation would particularly affect young people who make their way particularly quickly in Germany and who still meet the high demands on school successes and further integration requirements during the asylum procedure. In certain cases, young people who start training during the asylum procedure also threatens a ban on employment during the previous debt period and they would have to interrupt the training for one year.
